Neutral Citation No. - 2025:AHC:80105 Court No. - 5 Case :- WRIT - A No. - 6673 of 2025 Petitioner :- Vijay Bahadur Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Mamta Pandey,R.S. Pandey,Rajshree Malviya Counsel for Respondent :- C.S.C.,Shyam Mani Shukla Hon'ble Ajay Bhanot,J. The petitioner has been working as daily wager on the post of class IV since 1997 in the respondent-Nagar Panchayat. The petitioner claims that he is entitled for regularization of his service with effect from 31.12.2001. The only prayer made by Shri R.S. Pandey, learned counsel assisted by Ms.Rajshree Malviya, learned counsel for the petitioner is that the representation of the petitioner for regularization of his service may be decided within a stipulated period of time. Learned Standing Counsel for the respondents No.1 to 3- State and Shri Shyam Mani Shukla, learned counsel for the respondents No.4 and 5 submit that the matter requires factual determination and other considerations as per applicable laws and relevant rules as well as Government Orders by the competent authority in the first instance. However, they fairly contend that the claim for the petitioner for regularization of his service is liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent No.2- Director of Local Bodies, U.P. Lucknow and respondent No.4-Executive Officer, Nagar Panchayat Babarpur, Ajitmal, Auraiya/competent authority are directed to decide the representation of the petitioner for regularization of his service as per law within a period of three months from the date of receipt of a certified copy of this order alongwith a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
