The petitioner claims that he is entitled to one time ex- gratia money on account of death of her husband on Covid-19 duty in the department. A representation in this regard has been made to the competent authority which has not been decided till date. The only prayer made by Sri Syed Riyaz Askari, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Sri Pranjal Mehrotra, learned counsel for the respondents no. 4 submits that the matter requires determination of facts by the competent authority as per law in the first instance. However, he fairly contends that the service benefits/salary claims are liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 2 is directed to decide the representation of the petitioner for one time ex-gratia money on account of death of her husband on Covid-19 duty in the department as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
