HON'BLE MR. JUSTICE C. HARI SHANKAR HON'BLE MR. JUSTICE OM PRAKASH SHUKLA
JUDGMENT (ORAL) % 18.11.2025 C. HARI SHANKAR, J.
1. This is a case in which there are concurrent findings of DME1 and RME2 to the effect that petitioner’s haemoglobin count is below the minimum haemoglobin count permissible for recruitment to the post of Assistant Commandant in the Central Armed Police Forces.
2. The petitioner’s case appears to be that he is an outstanding performer in the Forces. That cannot, however, be a consideration which mitigates the effect of low haemoglobin count.
3.
Learned Counsel for the petitioner has also drawn our attention 1 Detailed Medical Examination 2 Review Medical Examination
W.P.(C) 9358/2023 p. 2 to Clauses 6(c) and (d) of the Guidelines for Review Medical Examination (RME) in Central Armed Police Forces & Assam Rifles.
4. Insofar as Clause 6(c) is concerned, there is complete compliance with the said clause, as the decision to disqualify the petitioner is based on blood reports which have identified his haemoglobin count.
5. As such, the requirement of proper investigation reports stands complied with.
6. Insofar as Clause (d) is concerned, the requirement of obtaining opinions of concerned specialists and super specialists is only in the case of doubt.
7. There is no doubt in this case. As such, this clause is inapplicable.
8. There is no merit in the petition, which is accordingly dismissed.
