ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ^ seeking to enlarge the Petitioner/Accused No.4 on bail in Crime No. 170 of 2025 of Duvvur Police Station, YSR Kadapa District, was registered against the Petitioner/AcCused No.4 herein for the offences punishable under Sections 303(2), 109, 132, 49 read with 3(5) of the Bharatiya Nyay Sanhita, 2023 ^ and Section 20(1)(C)(ii)(iii)(iv)(vi)(x), Section 20(d)(i)(a)(b)(ii)(a)(b) of the Andhra Pradesh 'The BNSS 2 The BNS
2 Dr.YLR, J CrI.P.No.10179 of 2025 Dated 14.10.2025 Amendment Act, 1967^ and Rule 3 of Andhra Pradesh Sandal Wood and Red Sanders Wood' Transit Rules 1969^ and Prevention of Damage to Public Property Act, 1984^ and Section 51 of the Wild Life Protection Act, 1972® on the allegation that the Petitioner/Accused No.4 is involved in red senders smuggling. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 2. 3. As seen from the record, the allegation against the Petitioner/Accused No.4 is that he acted as a coolie in cutting down red senders trees and converting them into 42 logs weighing about 204.300 kilograms. The petitioner was arrested on 28.08.2025 and has been in judicial custody for the past 48 days. So far, seven witnesses have been examined, all of them are official witnesses. A substantial portion of the investigation, insofar as it relates to the alleged role of the petitioner, has been completed. The petitioner is a permanent resident of Ravindra Nagar, Kadapa City, Y.S.R. Kadapa District, and has a fixed place of abode. Therefore, the possibility of the petitioner or hampering the tampering with evidence, threatening witnesses investigation does not arise. ^ The Act The Rule ® The Act ® The Act

Considering the facts and circumstances of the case, the nature and gravity of the allegations leveled against the Petitioner/Accuse d No.4, this Court is inclined to enlarge the Petitioner/Accused No.4 on bail. 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.4 shall be enlarged on bail subject to he executing a persohal bond for a sum of Rs.
10,000/- (Rupees Ten Thousand Only) with two sureties for the like sum each to the satisfaction of the learned’Special Judicial Magistrate of I Class for trial of Cases Relating to Red Sanders Smuggling, ii. The Petitioner/Accused No.4 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court, iii. The Petitioner/Accused No.4 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned, iv. The Petitioner/Accused No.4 shall not commit or indulge in commission pf any offence in future. V. The Petitioner/Accused No.4, shall not, direbtly or indirectly, make any inducement, threat or promise to any person acquainted with the
facts of th^ case so as to dissuadp him/her from disclosing such facts to the court or to any police officer. vi. The Petitioner/Accused No.4 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have a passport, he shall submit an affidavits to that effect to the Investigating Officer.
