Mr. Deepak Bisht, Deputy Advocate General for the State of Uttarakhand. 2. These first bail applications have been moved by the applicants, seeking regular bail in Case Crime/F.I.R. No.430 of 2024, under Section 109, 115(2), 117(2), 191(2), 351(2), 352 of B.N.S.S., registered at Police Station Kashipur, District Udham Singh Nagar. 3. It is contended by learned counsel for the applicants that applicants have falsely been implicated in the instant crime; have no criminal history and are languishing in jail since long. Learned counsel for the applicants submits that, at the time of arrest, the applicants were not communicated the reasons for their arrest. It is further contended that co- accused, namely, Koshinder has already been enlarged on bail by this Court in BA1 No.2499 of 2024 vide order dated 21.03.2025. He submits that this is a case of parity and in case, the applicants are granted bail, they will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel vehemently opposed the bail application and submits 2025:UHC:5215 that there are eyewitnesses and CCTV footage of the incident. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicants deserve bail at this stage on the ground of parity. 6. The bail applications are allowed. 7. Let the applicant, namely, Suraj, Kuldeep Singh and Goldi Pant be released on bail, on executing personal bond by each one of them and furnishing two reliable sureties by each one of them, each of like amount, to the satisfaction of Court concerned.
