Heard Mr. Y.S. Mannan, the learned counsel appearing for the petitioner as well as Mr. RR Kaushik, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner Amijul Ali has prayed for releasing him on bail, after he was arrested in connection with Dharamtul
Page No.# 2/2 P.S. Case No. 47/2024. 3. It may be stated that the aforesaid case has been charge-sheeted. 4. Mr. Kaushik has objected to this bail application on the ground that there are sufficient incriminating materials against the present petitioner. According to Mr. Kaushik, the petitioner belongs to a group of people who operates within the district of Morigaon and commits robbery in different places. 5. Mr.Mannan has submitted that the wife of the petitioner is in advanced stage of pregnancy. 6. Mr. Mannan further submits that the petitioner is also suffering from chest pain and breathing problem with anxiety. According to Mr. Mannan, the petitioner shows an abnormal ECG. 7. There are some incriminating materials against the present petitioner but the grounds on which the bail application has been filed are found to be reasonable. 8. I have considered the submissions made by the learned counsels of both sides. 9. This Court is of the opinion that the petitioner does not deserve to be detained in custody. Therefore, his bail application is allowed. 10. It is hereby directed that the petitioner, Amijul Ali, who was arrested in connection with Dharamtul P.S. Case No. 47/2024, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Sessions Judge, Morigaon. 11. It is further directed that on each and every date of hearing, the petitioner shall regularly appear before the trial court without showing any satisfactory reason. The learned Sessions Judge, Morigaon shall have the liberty to procure his attendance.
With the aforesaid direction, the bail application stands disposed of. JUDGE Comparing Assistant
