ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue an appropriate Writ, order or direction mostly one which is in the nature of a Writ of Mandamus declaring the inaction of the 2nd Respondent in taking a decision on the Representation of the Petitioner dated 03-10-2025 for shifting of the licensed premises under the Andhra Pradesh Excise (Grant of License of Selling by Shop and Conditions of License) Rules, 2024 despite submission of all reports by other concerned authorities as illegal, irregular, arbitrary, unjustified and unsustainable and consequently direct the 2nd Respondent to forthwith pass orders on the Representation of the Petitioner dated 03-10-2025 for shifting of the licensed premises under the Andhra Pradesh Excise (Grant of License of Selling by Shop and Conditions of License) Rules, 2024 and pass such other order or orders…”

The petitioner was granted a license to sell Indian Made Foreign Liquor and Foreign Liquor by shop through LOTs, vide Gazette Sl.No.L.No.06/2024- 26, for the period from 16.10.2024 to 30.09.2026, and was issued Form A-4 license on 30.10.2024. The shop was approved to be located at D.No.101/198-1, Angadi Veedhi, Kadapa, YSR Kadapa. 3. While things stood thus, the petitioner submitted a representation on 03.10.2025 seeking permission to shift his shop from D.No.101/198-1, Angadi Veedhi, Kadapa, YSR Kadapa to D.No.1/43 & 1/44, R.S.Road, Yerramukkapalli, Kadapa Municipal Corporation, stating that the existing premises was not economically feasible and unsuitable for conducting business. 4

As there was no response to the aforesaid representation dated 03.10.2025, the present writ petition has been filed seeking a direction to the respondents to take decision on the petitioner’s representation 03.10.2025 for shifting licensed premises under the Andhra Pradesh Excise (Grant of License of Selling by Shop and Conditions of License) Rules, 2024. 4. As the prayer is innocuous, the present Writ Petition is disposed of directing the respondent authorities to consider the petitioner’s representation dated 03.10.2025 and pass appropriate orders, in accordance with law, after issuing notice to the affected parties, if any, within a period of four (04) weeks from the date of receipt of a copy of this order.
