By the present writ petition, the petitioner, who is owner of the land bearing Khasra No.288 area of 0.223 Hectare situated at village Patpara, Puchhapara Katghora, District Korba, is seeking a direction towards the respondent authorities for payment of compensation with respect to the land owned by the petitioner which has been used by the respondent authorities for construction of building of Government Middle School. 2. Learned counsel appearing for the petitioner submits that the land of the petitioner has been utilized by the respondent authorities for construction of building of Government Middle School and no compensation has been paid to the petitioner till date and no acquisition proceeding has been initiated by the concerned authorities. 3. Learned counsel appearing for the State submits that the grievance of the petitioner will be duly verified and by making a demarcation and spot inspection by the competent authorities, if the land of the petitioner found to be utilized for construction of the school building, necessary steps will be taken for acquisition of the land and payment of compensation. 4. I have heard learned counsel for the parties and perused the documents. 5. From perusal of the documents particularly Annexure P/3 i.e. Panchnama prepared by the Revenue Inspector, Tahsil Pali, District Korba, it appears that the land of the petitioner has been 3 / 3 stated to be utilized for construction of the building of Government Middle School and no payment of compensation has been made to the petitioner with respect to the subject land. 6. In view of the above, the Collector, District Korba is directed to make verification and demarcation of the land in question and if the land of the petitioner found to be used for construction of the building of Government Middle School, necessary steps be taken for acquisition of the land and ensure payment of compensation towards the land of the petitioner. Necessary steps be taken within a period of 50 days from the date of receipt of a copy of this order. 7. With the aforesaid direction, this writ petition is disposed of.
