Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the respondents on petitioner's Online Application dt. 26.09.2023 submitted to delete the land of Ac.
1.01 cents in Survey No.320-12 situated at Korada Village in Hiramandalam Mandal of Srikakulam District, from the list of prohibited properties under Section 22-A (1) (a) of The Registration Act, 1908 and consequential inaction of the respondents on petitioner's Representation dt. 25.08.2025 submitted to return the possession of my land admeasuring Ac.1.10 PERCENT cents in Survey No.320-12 situated at Korada Village in Hiramandalam Mandal of Srikakulam District which is notified in the land acquisition proceedings for BRR Vamsadhara Project in the year 2017 as the said land is not utilized for the said project, as illegal, irregular, arbitrary, violative of the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and rules framed thereunder and offends articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents to return the petitioners land admeasuring Ac.1.10 PERCENT cents in Survey No.320-12 situated at Korada Village in Hiramandalam Mandal of Srikakulam District and also delete the said land from the list of prohibited properties under Section 22-A (1) (a) of The Registration Act, 1908 and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to return the petitioner’s land admeasuring Ac. 1.10 % cents in Survey No.320-12 situated at Korada Village in Hiramandalam Mandal of Srikakulam District and also delete the said land from the list of prohibited properties under Section 22-A (1) (a) of The Registration Act, 1908, by considering the Online Application dt. 26.09.2023 and Representation dt. 25.08.2025, pending disposal of the main Writ Petition and pass Counsel for the Petitioner:

ORDER:-
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents on petitioner's Online Application dt. 26.09.2023 submitted to delete the land of Ac. 1.01 cents in Survey No.320-12 situated at Korada Village in Hiramandalam Mandal of Srikakulam District, from the list of prohibited properties under Section 22-A (1) (a) of The Registration Act, 1908 and consequential inaction of the respondents on petitioner's Representation dt. 25.08.2025 submitted to return the possession of my land admeasuring Ac.1.10 PERCENT cents in Survey No.320-12 situated at Korada Village in Hiramandalam Mandal of Srikakulam District which is notified in the land acquisition proceedings for BRR Vamsadhara Project in the year 2017 as the said land is not utilized for the said project, as illegal, irregular, arbitrary, violative of the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and rules framed thereunder and offends articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents to return the petitioners land admeasuring Ac.1.10 PERCENT cents in Survey No.320-12 situated at Korada Village in Hiramandalam Mandal of Srikakulam District and also delete the said land from the list of prohibited properties under Section 22-A (1) (a) of The Registration Act, 1908 and pass”
2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. 3. The learned counsel for the petitioner has brought to the notice of this Court that the earlier respondents, who were trying to interfere with the possession of the petitioner, had approached this Court by filing W.P. No.10809 of 2020. Considering the material and submissions, this Court granted an interim direction on 10.07.2020.
Subsequently, the said writ

petition was disposed of vide order dated 06.08.2020 based on the instructions placed by the learned Government Pleader, which reads as follows:
“Recording the said submission that the land is not presently being taken over by the respondents, this writ petition is closed. In the event, the respondents require the land of the petitioner for any purposes in future, they shall take over the land only in accordance with the procedure known to law and after giving adequate notice and opportunity of hearing to the petitioner. There shall be no order as to costs”. 4. Subsequent to the disposal of the writ petition, the respondents have included the land admeasuring Ac.1.01 cents in Sy.No.320-12B in the prohibited properties list. When the petitioner came to know of the same, he immediately filed an online application on 26.09.2023 seeking deletion of the land admeasuring Ac.1.01 cents in Sy.No.320-12B situated at Korada Village, Hiramandalam Mandal, Srikakulam District, from the prohibitory properties list under Section 22-A(1)(a) of the Registration Act, 1908. Despite the said request, the respondent authorities have not considered or removed the said property from Section 22-A(1)(a) of the Registration Act, 1908. Hence, the present writ petition. 5. Considering the submissions made by the learned counsel for the petitioner and on perusal of the record, as more than two years have already lapsed. 6. In view of the same, this writ petition is disposed of at the admission stage by directing the respondents, more specifically the 3rd respondent, to consider the application made by the petitioner and pass appropriate orders

after obtaining a report from the concerned authorities, i.e., respondent Nos.4 and 5, and by issuing notice to the concerned. The said exercise shall be completed within a period of three (03) months from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
