...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a Writ, order or directions, more particularly one in the nature of Writ of Mandamus, declaring illegal action of the respondents 2 to 6 in interfering in civil disputes in collusion with the respondents 7 and 8 in respect of Jerusalem Prayer House (Church) located in Door.No.40/36-A, LIC office, River View Colony, Kurnool City, having withdrawn the MC.No.669/2022, dated 15-09-2022, i.e U/s 145 Cr.P.C., in view of the order in CrI.Rc.827 of 2022, dated 13-0992022, which is illegal, arbitrary, unjust, contrary to the provisions of Section 145(1) Cr.P.C., without jurisdiction or power and violation of Articles 14,19 and 300-A of the Constitution of India, and consequently direct the respondents 2 to 6 not to interfere in civil disputes particularly in to subject Church, or otherwise Petitioners Society and devotees will suffer serious loss and great hardship and pass IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to grant interim directions directing the respondents 2 to 6 not to interfere in civil disputes particularly in respect of Jerusalem Prayer House (Church) located in Door.No.40/36-A, LIC office, River View Colony, Kurnool City, further directions to the respondents to permit the petitioners society alone to perform the prayers with devotees, pending disposal of the Writ Petition and pass Counsel for the Petitioner(S):

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ, order or directions, more particularly one in the nature of Writ of Mandamus, declaring illegal action of the respondents 2 to 6 in interfering in civil disputes in collusion with the respondents 7 and 8 in respect of Jerusalem Prayer House (Church) located in Door.No.40/36-A, LIC office, River View Colony, Kurnool City, having withdrawn the MC.No.669/2022, dated 15-09-2022, i.e U/s 145 Cr.P.C., in view of the order in CrI.Rc.827 of 2022, dated 13-0992022, which is illegal, arbitrary, unjust, contrary to the provisions of Section 145(1) Cr.P.C., without jurisdiction or power and violation of Articles 14,19 and 300-A of the Constitution of India, and consequently direct the respondents 2 to 6 not to interfere in civil disputes particularly in to subject Church, or otherwise Petitioners Society and devotees will suffer serious loss and great hardship and pass.…”
2. Heard Sri Ch. Sivasankar, learned counsel for the petitioners and Sri V. Farook, learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the petitioners would submit that the police are calling the petitioners to the police station and interfering with the civil disputes in between the petitioners and the unofficial respondents. Learned counsel would further submit that a direction may be given to the police.
4. Learned Assistant Government Pleader for Home, on written instructions would submit that eight criminal cases are pending against the
petitioners. In that light, the petitioners are called to the police station. He would further submit that the police are not interfering in the civil disputes between petitioners and the unofficial respondents.

Learned counsel for the petitioners would submit that recording the same, the petition may be disposed of.
6. Recording the above said submissions, the Writ Petition is disposed of. However, the police are directed to follow due procedure of law regarding the crimes which were registered against the petitioners and not to interfere in the civil disputes between the petitioners and the unofficial respondents. There shall be no order as to costs.
