Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 B.N.S.S., 2023 to challenge the order dated 15.4.2025 passed by District Judge, Jaunpur in Criminal Misc. Application No.76 of 2025, whereby his transfer application has been dismissed. Applicant also seeks transfer of Sessions Trial No. 98 of 2016, arising out of Case Crime No. 509 of 2014, under Section 306 I.P.C., Police Station Mariyahu, District Jaunpur, pending before the Additional Sessions Judge-II, Jaunpur to the Additional Sessions Judge-IV, Jaunpur. Learned counsel for submits that the final arguments were addressed before the Court No.2, Jaunpur, but before the judgment could be pronounced, the Presiding Officer has been transferred to Court No.4. He prays that it would be in the interest of justice, if the matter is again transferred to Court No.4 and the request made in this regard has been rejected by the Sessions Judge, Jaunpur vide order dated 15.4.2025. Learned counsel for applicant has not disputed this fact that the Court No.2 had not reserved the judgment and new incumbent has joined the Court No.2 at Jaunpur. Thus, the sole ground raised for transfer of the case is not sufficient. The application fails and is hereby dismissed.
