ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“…to issue a Writ of Mandamus, or any other appropriate writ, order or direction, declaring the action of the 3rd and 4th Respondents in illegally interfering with the Petitioner’s construction activity in the property admeasuring an extent of 5 cents (242 sq. yards), D.No. 6/391-H-18, in Sy. Nos. 943 and 944, A.B.N.R. Colony, Rajampeta Town and Mandal, YSR Kadapa District, as illegal, arbitrary and without jurisdiction, and further direct Respondents 3 and 4 not to interfere with the construction activity of the Petitioner in the said property…”
2. No representation for the writ petitioner. 3. Sri R. Mallikarjuna Rao, learned Assistant Government Pleader for Home, appearing on behalf of respondent Nos. 1 to 4, on written instructions, submits that the police enquiry reveals that the matter is civil in nature and, therefore, they will not interfere in the matter. 4. The submissions of the learned Assistant Government Pleader that the matter is civil in nature and that the police will not interfere are placed on record. 4
5. In view of the submissions made by the learned Assistant Government Pleader, no further orders are necessary in the writ petition. 6. Accordingly, the Writ Petition is closed at the admission stage without going into the merits of the case. There shall be no order as to costs.
