The writ petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents particularly respondents 5 and 8 in insisting the petitioner to appear before their authority for being bound over as B-Party and further insisting him not to enter into his house site property admeasuring 473 Square Yards in Survey No. 387/1 of Uppugunduru Village in Naguluppalapadu Mandal of Prakasam District is illegal, irregular and irrational and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents particularly respondents 5 and 8 to grant the petitioner necessary police aid to protect his possession over his said house site property and pass...”
2. Heard Ms.Nimmagadda Revathi, learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3. The learned counsel for the petitioner would submit that, respondent police are insisting him to appear before the authorities for being bound over as B-Party and are allegedly restraining him from entering into the disputed house site property. 3. Sri V.Farooq, learned Assistant Government Pleader for Home on written instructions would submit there is a long-standing land dispute
between the petitioner and one Bellam Nammaiah Babu. Several civil and criminal proceedings are pending between the parties, vide Crime No.15 of 2018 and Crime No.173 of 2019 on the file of Naguluppalapadu Police Station. He would further submit that preventive bind-over proceedings were initiated against the petitioner only to maintain law and order and that the police have not interfered in the civil disputes between the parties. 5. Considering the submissions, the writ petition is disposed of. However, police are directed not to interfere in the civil disputes except under due process of law.
