This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.458/2025 registered at Police Station GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.10.13 11:02:23 +0530 2 Kharora, District-Raipur (C.G.) for the offence punishable under Sections 105, 110 of BNS. 2. As per prosecution story, in brief, is that the case diary along with the report of crime no.458/2025 of Kharora police station under section 105, 110 of B.N.S. was observed. It is shown that the applicant drove his truck in the opposite direction and hit two different motorcycle at two different places on 14.07.2025, due to which two persons riding the said motorcycles died on the spot and three persons were injured and were undergoing treatment. 3. Learned counsel for the applicant submits that the applicant is a truck driver and he has collided three persons who were going on a motorcycle out of which two have died and one has suffered injuries. It is stated that it is a case of accidental in nature. He would submit that charge sheet has been filed, the applicant is in jail since 14/07/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and she would submit that charge sheet has been filed in this case. She would further submit that two persons have lost their lives on account of the fact that the applicant was driving a truck and the same had entered in a collision and the applicant is also having a criminal history of a similar nature of the year 2022, therefore he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case 3 diary. 6. Considering the facts and circumstances of the case, considering the fact that two persons have lost their lives on account of the fact that the applicant was driving a truck and the same had entered in a collision with the motorcycle and also considering the fact that the applicant is also having a criminal history of a similar nature of the year 2022, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Ramulal Sahu involved in Crime No.458/2025 registered at Police Station Kharora, District-Raipur (C.G.) for the offence punishable under Sections 105, 110 of BNS, is rejected. 8.
