ANSHUMAN ORAL ORDER 2 09-07-2025 Heard Learned Counsel for the petitioner and Learned APP for the State. 2. The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioner who apprehends her arrest in connection with Pupari P.S. Case No.59 of 2025 lodged on 20.02.2025, for the offences punishable under Sections 126(2), 115, 352, 351(2), 118(1), 109 and 3(5) of the BNS, 2023. 3. As per the prosecution, FIR has been lodged against three named accused persons including the present petitioner with allegation that all accused persons with lathi & danda, started abusing the informant. Upon oppose, they started Patna High Court CR. MISC. No.42488 of 2025(2) dt.09-07-2025 2/3 assaulting the informant’s husband due to which injury has been caused and referred to hospital and 18 stitches have been given in his head. 4. Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that in the FIR, it has been indicated that both petitioner and informant are adjacent neighbourer and they used to reside in sitamarhi town for arranging study of their children. 5. Counsel further submits that due to petty dispute among the children, the family member of both sides started scuffling due to which injury has been caused. For the said occurrence, two FIRs has been lodged with delay. 6. Counsel submits that the criminal antecedent of the petitioner is clean. He further submits that there is no specific allegation against the petitioner. 7. Learned APP for the State opposes the prayer for bail of the petitioner and submits that upon perusal of both FIRs, it transpires that injury caused to both parties. 8. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on Patna High Court CR. MISC. No.42488 of 2025(2) dt.09-07-2025 3/3 furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of S.D.J.M, Pupri, Sitamarhi in connection with Pupri P.S.
