This is a petition preferred under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) seeking anticipatory bail in FIR No.450, dated 02.10.2024, under Sections 420,406,120-B of IPC, registered at Police Station City Fatehabad. 2. The FIR in the present case was registered on the basis of the statement made by Ram Lal and the same has been reproduced below:- Legal action to be taken against 1. Inderpal son of Mr. Khan Chan J Mo. No. 94679-82440, 98960- 82440 2. Sudesh wife of Mr. Inderpal resident of Indri district Karnal for cheating money in the name of getting a job in Group D. Respected Sir, my humble request is that we are residents of Fatehabad and the above accused, Inderpal, son of Mr. Khan Chand and his wife, are residents of Indri, of District Karual. Who told us around HITESH 2025.08.07 09:17 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-24325-2025 -2 10/2018 that one of my acquaintances is in the Chief Minister's office and he will get jobs for 5-6 people. After that he started trapping all the relatives one by one and one day he called all the relatives and acquaintances to Fatehabad on Sunday and both Inderpal and his wife Sudesh came in their personal car and he came to Fatehabad and collected Rs. 27 lakhs 45 thousand from all the relatives an I asked to deposit the remaining money in the bank account. He sent a WhatsApp message on 29.12.2018 on mobile bearing number 94161-55292 and said that I am sending you the roll numbers of all the people who have been confirmed for employment in D- Group from the CM office. But he could not get even a single job and he kept on giving us false promises and he kept on fooling us towards an honest government. Later, we held a Panchayat in this regard in which he admitted that he owed us the money and he will soon take it from his acquaintance in the Chief Minister's office and give it back and then several Panchayats were held on which he gave a cheque of Rs 22 lakı dated 24.04.2019 in the name of Vijay Kumar. And he said I am giving you this cheque as a guarantee, do not deposit it in the bank because I will come to Fatehabad and return your money in cash this month. But he kept making false statements again and again and neither allowed us to deposit the chec nor gave us cash. After that Panchayats were held many times but till today, he has given us only three lakh rupees which was paid on Google on 9416155292. He has not given the remaining 27,00,000/- rupees till date. In our last Panchayat on Sunday, November 2022, at his house where he now lives on rent in HUDA Sector in Karnal, he said that I do not have to give you any money and neither will I give it and he abused the Panchayat members and me and also threatened to kill me if I come again. Please take HITESH 2025.08.07 09:17 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-24325-2025 -3 legal action against the above accused for taking money by luring us, threatening to kill us and spoiling the image of the government and get our money back with 12% annual interest so that in future the above accused cannot cheat anyone else and the public's faith in the honest government remains intact. Saawan Ram, resident of Rajiv Colony, Fatehabad.” 3. Learned counsel for the petitioners contends that the allegations levelled by the complainant in the present case are palpably false and unbelievable. He further contends that in fact, no amount was taken by the petitioners from the complainant in the present case and they had never promised to get employment in Group-D to the complainant. Further, an amount of Rs.27,45,000/- was taken as a friendly loan by the petitioners from HITESH 2025.08.07 09:17 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-24325-2025 -4 the complainant, however, the said amount has already been returned by them. Even, the petitioners had never promised to get the employment to the complainant or any other persons. 4. On the other hand learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioners on the ground that the petitioners had taken a sum of Rs.30,00,000/- from Ram Lal son of Saawan Ram. Further, both the petitioners had also cheated four more innocent persons. He further submits that the statements of all the victims have been recorded by the police, during the course of investigation. 5. I have heard the learned counsel for the parties and perused the record carefully. 6. In the present case, the complainant has levelled serious allegations against both the petitioners that they had cheated the complainant to the tune of Rs.30,00,000/- for getting employment in some Government department. Moreover, apart from the complainant, the petitioners had cheated four more innocent persons and their statements have been recorded by the police, during the course of investigation. Still further, they have also received the documents from all the victims in the present case. Even, the documents which were collected by the petitioners are yet to be recovered by the police. 7. Thus, keeping in view the gravity of the offence as well as need for custodial interrogation, the petitioners are not entitled to concession of anticipatory bail in the present case. 8. Dismissed, accordingly.
