ORDER:
This Writ Petition under Article 226 of the Constitution of India, has been filed, by the Petitioner for the following relief:
“ ... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the Respondent No.1 in interfering with the civil disputes between the Petitioner and the Respondent No.4 relating to custody of the minor child which is ceased by the competent civil court in GWOP No.298/2024 on the file of the Principal District Judge, Guntur without following due process of law as arbitrary, illegal and violation of Article 14 and 21 of the Constitution of India and consequently direct the Respondent No.1 not to interfere in the civil disputes pending between the Petitioner and the Respondent No.4 in respect of the custody of the minor child named Pattan Lemuel Paul Azaliah pending disposal of the GWOP No.298/2024 on the file of the Principal District Judge, Guntur without following due process of law in the interest of justice. ...”
Heard learned counsel for the Petitioner and Learned Assistant Government Pleader for Home representing for respondent State. Perused the material on record.
Learned Assistant Government Pleader on instructions would submit that Petitioner’s son married respondent No.4 and they blessed with a son, who is aged about 10 years by the time of filing of this Writ Petition. His son died in the year 29.04.2022. Further, his grand-son is living with him. Seeking custody of the child, Petitioner filed GWOP No.298 of 2024 on the file of the Court of Principal District Judge, Guntur, which is pending for adjudication. The allegation made against the respondent Police by the Petitioner is not true and police never interfered in the issue between the parties which is related to custody of the minor child and the matter is pending with the competent civil Court and requested to dispose of the Writ Petition by passing appropriate orders.

Learned counsel for the Petitioner would submit that recording the said submission, this Writ Petition may be disposed of.
In that view, this Writ Petition is disposed of. Petitioner is at liberty to work out the remedy before the competent civil court where the matter is pending for adjudication. No order as to costs. Pending applications, if any, shall stand closed.
