In the instant contempt petition, the petitioner has alleged non compliance of order dated 20.05.2024, in terms whereof while disposing of the WP(C) No. 3576/2019 filed by the petitioner, respondent/Commissioner Secretary came to be directed to consider the case of the petitioner in accordance with the provisions of law and in his absence, by the competent authority/Secretary, within a period of two months. 2. Compliance report has been filed by the respondent accompanied with the consideration order dated 12.11.2024, wherein it is being inter alia stated that the claim of the petitioner came to be examined pursuant to the order passed by this Court in consultation with the Liquidator appointed by JAKFED, which stands wound up in the year 2019 by the Registrar Cooperative Societies J&K and a Liquidator consequently appointed there to, whereupon the said Liquidator published a notice in the leading newspapers on 07.03.2020 and 15.05.2020, calling upon all the stakeholders to lodge their claims, if any, against JAKFED along with documentary evidences in support of their said claims and that the petitioner did not lodge or furnish any claim in the office of the Liquidator Sr.No. 26 2 CCP(S) No. 451/2024 despite sufficient time have had been provided for putting forth the said claims and that the claim of the petitioner stands considered and rejected after being found devoid of any merit. 3. Having regard to the aforesaid specific stand taken by the respondent/contemnor, seemingly, the respondent/contemnor has complied with the order, non compliance of which is alleged in the instant petition. Contempt notice issued is, accordingly, recalled and the proceedings are closed with liberty to the petitioner to work out a remedy as available in law against the consideration order dated 12.11.2024.
