2. Petitioners have been made accused in connection with Dhanwar P.S. Case No. 249 of 2024 for the offences registered under sections 126(2), 191 (1) (2), 117(2), 115(2), 109, 103(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of Mr. Mahboob Alam, learned J.M.F.C., Giridih.
3. On 15.10.2024 at 2.00 p.m., there was free fight between the husband of the Informant and accused persons over the land dispute. It appears that co-accused Prakash Rana caught hold of the hands of the husband of the Informant while accused Mahesh Rana and Kuldip Rana gave axe blow on the head of the deceased, due to which, he succumbed to his injuries.
4. It was submitted that there is no allegation of overt act against the petitioners.
5. Ms. Sushma Aind,, learned A.P.P has opposed the prayer for bail, but does not dispute the aforesaid facts.
6. In view of the submission made above, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above named, are
directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each, with two sureties of the like amount each, to the satisfaction of Mr. Mahboob Alam, learned J.M.F.C., Giridih in connection with Dhanwar P.S. Case No. 249 of 2024.
