The above contempt case was filed, complaining of a violation of the
order dated 29.04.2024, passed in W.P. No. 10018 of 2024.
2. Heard learned counsel appearing on either side.
3. The petitioner filed the aforementioned writ petition to declare the inaction of Tahsildar, V Kota Mandal, in considering the representation dated 06.01.2023, as illegal and arbitrary.
4. The said writ petition was disposed of on 29.04.2024. The operative portion of said order reads as under:
“In view of the submission of learned counsel for the petitioner, without going into other aspects of the matter, the Writ Petition is
disposed of giving liberty to the petitioner to file application under Form- VIA of the Rules, 1989 before the 4th respondent. On receipt of such application, the 4th respondent shall follow the procedure i.e. issuance of notices to persons interested and affected etc., and pass appropriate orders, strictly in accordance with law, as expeditiously as possible.”
5. In the affidavit filed in support of the contempt case, it was pleaded that the petitioner made an F-line application instead of Form-VIA on 02.08.2024. The Village Surveyor issued notice under Section 23 of the Surveys & Boundaries Act, 1923. The Village Surveyor measured the land; however, not furnished the report and thus, violated the order dated 29.04.2024.
6. A counter-affidavit was filed by the respondent. Along with the counter- affidavit, an endorsement dated 09.09.2024 was also filed.
7. A perusal of the endorsement dated 09.09.2024, this Court is of the considered opinion that the respondent has not violated the order dated 29.04.2024, passed in W.P. No. 10018 of 2024, and the contempt case is liable to be dismissed.
8. Given the facts and circumstances of the case, the Contempt Case is dismissed. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
