The applicant has preferred this Second Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 367/2023, registered at Police Station- Fingeshwar, District- Gariyaband (CG) for the 2 offence punishable under Section 302 and 307 of IPC. 2. First Bail Application bearing MCRC No. 8469 of 2024 was rejected by this Court on 02.01.2025 on merits. 3. The prosecution story in brief, is that, the present applicant have assaulted her father and grandmother (Ghanaram Patel and Basanta Bai Patel) by means of stick and sickle due to which , they sustained grievous injuries and succumbed to the injuries. Based upon report, FIR was registered against the applicant and he was arrested. 4. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. He further contended that the chargesheet has been filed and the important witnesses cited by the prosecution has already been examined by the learned trial court. 5. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Also, there is no substantial change in 3 the circumstances of the case. Accordingly, the bail application of applicant- Egal Patel involved in Crime No. 367/2023 under Section 302 and 307 of IPC at Police Station- Fingeshwar, District- Gariyaband, Chhattisgarh, is rejected. 8. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 9.
