ANSHUMAN ORAL ORDER 2 16-07-2025 Heard Learned Counsel for the petitioners and Learned APP for the State. 2. The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioners who apprehend their arrest in connection with Makhdumpur P.S. Case No.132 of 2025 lodged on 25.02.2025, for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109(1), 303(2), 351(2) and 351(3) of the BNS, 2023. Patna High Court CR. As per the prosecution, FIR has been lodged against the present petitioners against whom there is allegation that the informant’s claim that all accused persons came at his house and told to the informant that don’t construct house as the land belongs to them and purcha is also with them and it is due to this reason, the accused has assaulted by iron rod to the informant due to which she fell down and injury has been caused. 4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel also submits that the petitioners were the genuine purcha holders from the Government and the informant is forcefully living on their land. He further submits that petitioners are not criminal rather right has been accrued by virtue of purcha then they want to oppose the said construction and due to this reason, scuffling took place between the person on whose favour, lawful papers are there and a person on whose favour, nothing is there. 5. Counsel submits that the criminal antecedent of the petitioners is clean. 6. Learned APP for the State opposes the prayer for bail of the petitioners and submits that petitioners have no Patna High Court CR. MISC. No.43951 of 2025(2) dt.16-07-2025 3/3 criminal antecedent. 7. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of A.C.J.M.-1st, Jehanabad in connection with Makhdumpur P.S.
