2. The petitioner has been filed this writ petition on the following relief(s) :

“10.1 That, the Hon'ble Court may kindly be pleased to call the entire records from the respondents. 10.2 That, this Hon'ble Court may kindly issue a writ in the nature of Mandamus directing the respondent authority to issue Permanent Social Status Certificate (Caste Certificate) to the Petitioner, prescribed period granted under Rule 9 & 10 of The Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes (Regulation of Social Status Certification) Rules, 2013. 10.3 That, the Hon'ble Court may kindly be pleased to direct the respondents by issuing the writ in the nature of mandamus to provide a permanent caste certificate of Schedule Caste to the petitioner on prescribed period 30th days granted under C.G. Lok Sewa Guarantee Act, 2011.”

Learned counsel for the petitioner contended that the petitioner belongs to Schedule Caste "Mahar" and petitioner children's wants to get the benefit of caste in the Chhattisgarh, the petitioner preferred online application No. 0704012301005284 & 0704012301005286 before competent caste certificate issuing authority S.D.O. (Revenue) Raipur district Raipur on 05/08/2023. The petitioner has also filed the relevant document application, affidavit with Inability Memo. The petitioner has brought this instant petition against the action of the respondent competent authority that the petitioner has sought documents before the year 1950, in which caste is mentioned, for issuance of permanent social status certificate, transaction description dated 13/09/2023.
4. Learned counsel for the petitioner has preferred an order passed by the Division Bench of this Court in case of Ku. Pooja Awsarmol Vs.
3 / 3 State of Chhattisgarh & Anr. passed on 20.07.2018 in WPC No.1890 of 2018.
5. Learned State counsel opposes the submission made by learned counsel for the petitioner.
6. Heard learned counsel for the parties and perused the documents available on record.
7. Considering the entire facts of the case and further considering the
order passed by the Division Bench of this Court in case of Ku. Pooja Awsarmol (supra), in which the Division Bench has passed the order for participation in counseling on the basis of temporary caste certificate which was already issued by the competent authority in favour of the petitioner, but in the present case, counsel for the petitioner has accepted that neither permanent caste certificate nor temporary caste certificate has been issued by the competent authority in favour of the petitioner, therefore, there is no ground to entertain this petition.
8. Accordingly, this petition is hereby dismissed.
