Petitioner has filed this writ petition seeking following reliefs:- “a. That, the Hon’ble Court may kindly be pleased to call the entire records from the respondent authorities. b. That, the Hon’ble Court may kindly pleased to direct the responden tno. 02/Collector Kabirdham to decide the petitioner’s application/representation dated 01/09/2025(Annexure P-1) which pending for grant of lease upon the part (900 sq. feet) of govt. land bearing Khasra NO. 122 measuring area 0.882 hectare situated at Village Panchayat Dullapur (Bazar), Kabirdham (C.G.) and till date no any step has been taken by him with mala5de intention. c. That, the Hon’ble Court may kindly pleased to direct the concern respondent authorities did not interfering the peaceful possession petitioner upon the part (900 sq. feet) of govt. land bearing khasra no. 122 measuring area 0.882 hectare situated at Village Panchayat Dullapur (Bazar), Kabirdham (C.G.) and till decision of the petitioner’s application/representation dated 01/09/2025. d. Any other relief, which may be deemed, 5t by this Hon’ble Court just and proper in the facts and circumstances of the case may also be provided in favor of the petitioner.” 2. Learned counsel for petitioner would submit that petitioner is in possession of the Govt. land by raising construction of small Kaccha House since last about 30 years. He further contended that petitioner has submitted an application before respondent no. 2 competent authority for grant of patta/lease of the land possessed by him which is pending consideration and therefore, direction be issued to respondent no. 2 to take decision on pending representation expeditiously. 3. Learned counsel for State submits that in view of the limited prayer made by counsel for petitioner and also that counsel for petitioner is not pressing this petition on merits and seeking direction to respondent no. 2 to take decision on the pending representation, she is having no objection. 4. I have heard learned counsel for respective parties. 3 5. On due consideration and submission made by counsel for respective parties, the pleadings made in writ petition as also the document enclosed, at this stage this writ petition is disposed of directing respondent no. 2 to take decision on the application submitted by the petitioner (Annexure P-01) in accordance with law expeditiously preferably within a period of six month from the date of receipt of copy of this order, if already not decided. 6. With the aforesaid direction, the present writ petition is disposed of.
