With the consent of the parties, heard finally. 2. The petitioner has filed this writ petition on the following reliefs: “10.1. That this Hon’ble Court may kindly be pleased to issue appropriate writ whereby set-aside/quash the impugned order dated 07.08.2025 passed by the respondent no. 2/Collector in Revenue Case No. 202507321400002/Section 85/2024-2025 whereby appeal filed by the petitioners have been rejected and resolution dated 23.06.2025 passed by respondent no. 4/Janpad Panchayat Baramkela with respect of 15th Financial Work Project (Agenda No. 1) has been maintained. (Annexure P/1). 10.2 That, this Hon’ble Court may kindly be pleased to issue appropriate writ/direction/order to respondent authorities to put the work project of the petitioners for 15th Finance Work Project thereafter pass the resolution by following the provisions of Chhattisgarh Panchayat 4 Raj Adhiniyam 1993 and Chhattisgarh Panchayat (Procedure of Meeting and Conduct of Business) Rules, 1994. 10.3 That, this Hon’ble Court may kindly be pleased to pass any appropriate orders/directions in favour of the petitioners looking to the facts and circumstances of the case. ” 3. Learned counsel for the petitioners submits that the petitioners are challenging the legality and propriety of the impugned order dated 07.08.2025 passed by the respondent no. 2/Collector in Revenue Case No. 202507321400002/Section 85/2024-2025 whereby appeal filed by the petitioners in view of liberty granted by this Hon’ble Court on 10.07.2025 in WPC No. 3541/2025 has been rejected and resolution dated 23.06.2025 passed by respondent o. 4/Janpad Panchayat Baramkela with respect to 15th Finance Work Project (Agenda No. 1) has been maintained. On 05.06.2025 the petitioners have made request application for including the work project for construction of work of 15th Finance Project of the year 2025-26 for their respective constituency by narrating the work project, estimate cost and the name of the respective village. On 16.06.2025 the respondent no. 4 has issued information letter that on 23.06.2025 the general body meeting of Janpad Panchayat Baramkela has been fixed on 23.06.2025 at 12:30 PM and fixed the agenda. The respondent no. 4 has not 5 mentioned the time for issuance of information letter. The respondent no. 4 has violated the rule 3(2) of the C.G. Panchayat (Procedure of Meeting and Conduct of Business) Rules 1994. the work project of 15th Finance year 2025-26 of Janpad Panchayat has been considered in which signature of 14 member of BDC is mentioned. 4. Learned counsel for the State submits that the District- Collector has passed the impugned order dated 07.08.2025 on the basis of the resolution of General Body Meeting of Janpad Panchayat Baramkela dated 23.06.2025. therefore, there is no illegality or invalidity in the order and the present petition deserves to be dismissed. 5. Heard learned counsel for the respective parties and perused the record with utmost circumspection. 6. The relevant portion of the impugned order dated 07.08.2025 is read as under: "उपरोक्त संपूर्ण अभिलेखों, प्रतिवेदन था उच्च न्यायालय के आदेश दिदनांक 10/07/2025 के आलोक में परीक्षर्ण उपरां यह स्पष्ट होा है दिक जनपद पंचाय बरमके ला की सामान्य सा की बैठक दिदनांक 23/06/2025 में पारिर प्रस्ाव क्रमांक 01 बहुम से अनुमोदिद हुआ है, जिजसमें अध्यक्ष सदिह 14 सदस्यों द्वारा सहमति व्यक्त की गई है था प्रस्ाव ैयार करने की प्रदिक्रया पूव दिनर्धाारिर काय योजना एवं सदिमति अनुमोदन के अनुरूप दिवतिर्धापूवक संपन्न हुई है। प्रस्ादिव 6 काय= की कनीकी स्वीकृ ति एवं स्थल दिनरीक्षर्ण की प्रदिक्रया दिनयमानुसार पृथक रूप से सुदिनति? की जाी है। आवेदकगर्ण द्वारा प्रस्ु आवेदन में दिकए गए आरोप थ्यहीन पाए गए हैं था प्रस्ाव के दिवतिर्धाक स्वरूप को प्रादिव नहीं करे। अः प्रस्ु आवेदन दिनरार्धाार होने से अस्वीकार दिकया जाा है एवं प्रकरर्ण में जारी स्थगन आदेश क्रमांक 2700, दिदनांक 07/07/2025 को समाप्त दिकया जाा है। साथ ही, सामान्य सा में दिवतिर्धापूवक एवं बहुम से पारिर प्रस्ाव को यथाव् मान्य रखा जाा है।" 7. Considering the facts and circumstances of the case, nature of grievance raised in this writ petition, submissions of the counsels for the respective parties, it is crystal clear that the District Collector has passed the order on the basis of the resolution of General Body Meeting of Janpad Panchayat dated 23.06.2025 which has been approved by the General Body Meeting of the Janpad Panchayat.
