1. Petitioner has filed this writ petition seeking following reliefs:
“1]. That, this Hon'ble Court may kindly be pleased to writ/writs, order/orders, direction/directions quashing the impugned order dated 01.12.2025, passed by SDO (Revenue), Sitapur, District Surguja (Ambikapur), Chhattisgarh, vide order bearing no. 1322/2025 and the petitioner may kindly be allowed to continue operation of Government Fair price shop at Village Beljora i.e. Shop ID no. 392003012. 2]. That, this Hon'ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.”
2. Learned counsel for the petitioner submits that vide order dated 21.11.2024 (Annexure P-3), petitioner was allotted Fair Price Shop. However, vide order dated 01.12.2025 (Annexure P1), said shop has been withdrawn from petitioner without granting any opportunity of hearing. He also contended that name of Self Help Group of petitioner is also not forming part of order dated 01.12.2025 but it only mentions name of Khadya Suraksha Poshan Avam Upbhokta Seva Sahkari Samiti Maryadit, Dharampur . 3 / 4
3. Learned counsel for the State raises an objection and submits that submission of learned counsel for the petitioner is not correct in view of documents enclosed along with writ petition. He contended that right on the Fair Price Shop of Beljora is never attached or allotted to petitioner- Group.
Annexure P-3 by which petitioner is claiming its right over the shop at Beljora, only deals with respect to Fair Price Shop of Village Panchayat Dharampur and run by Khadya Suraksha Poshan Avam Upbhokta Seva Sahkari Samiti Maryadit, Dharampur and it is this shop which was allotted temporarily to petitioner -Self help Group. Hence, no reliefs as sought in this writ petition can be granted to petitioner. 4. I have heard learned counsel for the parties and also perused the documents enclosed along with writ petition. 5. Petitioner is claiming right based on Annexure P-3 stating that petitioner was allotted Fair Price Shop vide order dated 21.11.2024. Contents of order Annexure P-3 would show that it deals with Fair Price Shop situated at Village Panchayat, Dharampur and earlier run by Khadya Suraksha Poshan Avam Upbhokta Seva Sahkari Samiti Maryadit, Dharampur . There is no mention of Fair Price Shop of Village/Village Panchayat Beljora. From perusal of order of allotment of shop by which petitioner is claiming right would show that it does not deal with Fair Price Shop of Beljora and order impugned Annexure P-1 is the order of allotment of shop to respondent No.5. 6. In view of aforementioned two documents ie. Annexure P-1 and Annexure P-3, it is prima facie evident that petitioner was not allotted Fair Price Shop at Beljora and therefore petitioner will not be permitted to challenge allotment of shop situated at Village/Village Panchayat
4 / 4 Beljora. 7. For the foregoing discussions, I do not find any good ground to admit this writ petition. 8. Accordingly, this writ petition is dismissed at admission stage itself. Sd/- Sd/- (Parth Prateem Sahu)
