1. Heard learned counsel for the parties. 2. The petitioners in this application pray for grant of anticipatory bail apprehending their arrest in connection with Goradih P.S. Case no.38 of 2025 registered for the offence punishable under sections 126(2), 115(2), 115(2), 118(1), 118(2), 109, 352, 351, (2), 351(2) and 3(5) of the Bharatiya
Patna High Court CR. MISC. No.43265 of 2025(2) dt.28-07-2025 2/3 Nyaya Sanhita, 2023. 3. As per the prosecution case, the accused persons including the eight petitioners herein are said to have assaulted the informant and others leading to injuries. 4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. There is case and counter case between the parties, the case filed by the petitioners side being Gauradih P.S. Case no.33 of 2025 being earlier to the case filed against them in which the application for bail has been moved. Learned counsel for the petitioners further refers to the order granting bail to the coaccused, Prakash Yadav and Manoj Yadav vide order dated 14.5.2025 passed in Cr.Misc. no.
30599 of 2025 to submit that the case of the petitioners herein stand on a similar footing to that of the said two co-accused and further referring to the order passed therein it is submitted that the injuries have been found to be simple in nature. The petitioners undertake to cooperate in the investigation/trial. 5. The application for bail is opposed by learned APP for the State. 6. No.43265 of 2025(2) dt.28-07-2025 3/3 general and omnibus in nature, the case of the petitioners being on similar footing to that of the above mentioned coaccused granted bail by the aforesaid order dated 14.5.2025 and the injury having been found to be simple in nature, it is directed that the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Goradih P.S. Case no.38 of 2025 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur.
