Both these bail applications arise out of same police case. Accordingly, they are being disposed of by a common order.
Petitioners have been made an accused in connection with Jarmundi P.S. Case No. 12/2024, Corresponding to G. R. Case No. 698/2024 for the offence under sections 392 of the Indian Penal Code, pending in the Court of Md. Zaved Khan, learned Judicial Magistrate, 1st Class, Dumka.
During the intervening night of 13/14.02.2024, the informant, while transporting fish on his pickup van bearing registration number JH-21-F-1655, was waylaid by three to four unknown persons.
Learned lawyer for the petitioners submitted that the petitioners are neither named in the FIR nor they were put on T.I. Parade. It was further submitted that nothing incriminating has been
recovered from the possession of the petitioners.
Learned A.P.P. has opposed the prayer for bail and submitted that the petitioners have got criminal antecedent.
Regard being had to the facts and circumstance of the case and considering the fact that there is no material against the petitioners on the record, the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of Md. Zaved Khan, learned Judicial Magistrate, 1st Class, Dumka or his successor in connection with Jarmundi P.S. Case No. 12/2024, Corresponding to G. R. Case No. 698/2024.
