Heard Mr. Pawan Kesharwani, learned counsel for the petitioner. Also heard Mr.S.S. Baghel, learned Deputy Government Advocate for the respondents/ State. 2. The petitioner has filed this petition praying for following relief:- “10.1 That this Hon'ble court may kindly be pleased to call for the entire Records. 10.2 That this Hon'ble Court may kindly direct the Police Authorities to file Charge-sheet against the Respondent No. 6 along-with all relevant documents (inquiry Report dated before the 10/08/2011) Learned Chief Judicial Magistrate Mahasamund in Crime No. 214/2013. 10.3 That this Hon'ble court may further be pleased to pass any other order in favor of petitioner as it may deem fit and proper under the facts and circumstances of the case with cost. 3. At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate prayer which is defective one, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer as the sections under which the offence is committed is not mentioned 3 and the copy of charge-sheet has also not been filed, counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh with proper prayer and complete documents. 4. Learned State counsel has no objection. 5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court for wasting precious time fo the court and the said amount shall be transmitted to the Government Multi-Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.). 6.
