Kaithamalai Kumaran For Respondent(s): Mr.N.Naveen Kumar Government Advocate For R1 to R3 R4 to R6 – Notice served, no appearance ORDER This writ petition has been filed for a direction directing the respondents herein to consider the petitioner's representation dated 16.03.2019 and to initiate proceedings to fix the boundary line for the poramboke lands in Old Survey No. 174B leading to the petitioner's lands in re-survey No. 196/1, Rakkiyapalayam Village, Uthukuli Taluk, within a time frame stipulated by this Court. 2.Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 to 3. https://www.mhc.tn.gov.in/judis WP No. 16279 of 2019 3.Though the petitioner owns a patta land adjacent to the poramboke land, the petitioner has no right to ask for fixing the boundary line for the poramboke lands. That apart, the property comprising in old S.No.174B, Rakkiyapalayam Village, has been now changed and re-surveyed as S.Nos.186/2 and 186/3 and patta Nos.454 and 233 issued in favour of one Malla Naicker and 11 others respectively. Further, there is no pathway in old S.No.174B of Rakkiyapalayam Village. Therefore, the representation submitted by the petitioner cannot be considered and the writ petition is devoid of merits and it is liable to be dismissed. 4.Accordingly, this writ petition stands dismissed. No costs.
