Learned advocate appearing for the petitioner raises issues relating to the seizure list as well as the arrest memo and submits that the petitioner has been falsely implicated in connection with the instant case. It has also been canvassed that the manner in which the arrest memo has been prepared would reflect that the same was subsequently prepared which is in clear violation of guidelines set down by the Hon’ble Supreme Court in D.K. Basu’s Case. The petitioner as such according to the learned advocate should be released on bail.
2 Learned advocate appearing for the State draws the attention to the contents of the seizure list wherefrom it is found that 13,536 capsules of SPSPHEN+ was seized along with 2304 capsules of the same contraband from the exclusive possession of the petitioner. The investigation of the case is still in progress. I have considered the submissions of the learned advocate appearing on behalf of the petitioner as well as the State and having regard to the stage of investigation of the case and the rigors of Section 37 of the NDPS Act, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 225 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
