Applicants Dilshad Hasan and Asif who are in custody in connection with FIR No.49 of 2024 dated 26.12.2024 u/s 8/20 of the NDPS Act, 1985 registered at P.S. Bhatraujkhan, District Almora, have sought their release on bail. 4. According to learned counsel for the applicants, commercial quantity of contraband (Ganja) is 20 kilograms. So far as joint recovery is concerned, 15.435 kilograms of contraband was shown to be recovered in the vehicle in which the accused were travelling. They are in custody since 24.12.2024 and 27.12.2024 respectively having no criminal history. 5. Learned State Counsel also admitted the fact that the recovery shown from the applicants is less than the commercial quantity; it is, however, submitted that there is one case of Gangsters Act registered against both the applicants. To this argument, learned counsel for the applicants submit that the FIR under the Gangsters Act was lodged against the applicants on the basis of present case only. 6. Having heard learned Counsel for the parties and on going through the facts of the case, applicants have been able to make out a case for bail at this stage. 7. Accordingly, both the bail applications are allowed. Applicants, named above, are directed to be released on bail on each of their executing personal bond and furnishing two-two reliable sureties by each of them to the satisfaction of the Court concerned. 8.
