The petitioner has filed the present petition under Section 483 of BNSS, with a prayer to grant interim regular bail to him for a period of six weeks from the date of release, in case FIR No.20 dated 16.09.2024, registered under Sections 21(c)/29 of NDPS Act 1985 (later on added Section 238 of BNS & 39/192 of Motor Vehicle Act 1988), Police Station SSOC, Fazilka, District Fazilka. 2. Learned counsel for the petitioner contends that the wife of the petitioner is at an advanced stage of pregnancy, which is apparent from her medical record (Annexure P-3). Due to this, the family members of both of them are not helping them. The petitioner has to provide proper medical aid, care attention to his wife. He further submits that during the pendency of the interim bail, the petitioner shall not go out of the jurisdiction of District Fazilka (Punjab). 3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that there are other family members of the petitioner, who may take care of the wife of the petitioner. However, he does not dispute the fact that the wife of the petitioner is pregnant and the expected date of delivery is 27.05.2025. 4. I have heard the learned counsel for the parties and perused the record carefully. 5. In the present case, admittedly the wife of the petitioner is pregnant and the expected date of delivery is 27.05.2025. Consequently, the petitioner is granted the concession of interim bail for a period of two weeks to take care of his wife and to pay her attention. 6. Without commenting on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on interim bail for a period of two weeks, pending trial on his furnishing bail bonds and surety to the satisfaction of the concerned trial Court/ Duty Magistrate/Chief Judicial Magistrate subject. 7. The petitioner shall also file an undertaking before the concerned Court that he shall not move out of the jurisdiction of District Fazilka (Punjab) during this period of interim bail.
