1. Learned counsel for the petitioners submits that the petitioners were admitted to anticipatory bail by the
2 Co-ordinate Bench of this Court in CRM (A) 331 of 2025 dated 22nd May, 2025. Learned counsel submits that while granting the anticipatory bail, the Co- ordinate Bench imposed a condition that the petitioners shall not enter the jurisdiction of Kharibari Police Station except for the purpose of meeting the Investigating Officer as and when summoned. Learned counsel further submits that petitioner no.1 Nantu Mandal and petitioner no.2 Manisha Sarkar are the elected members of Kharibari Panchayat Samiti.
Learned counsel also submits that on account of the condition they have not been able to attend the meeting of Kharibari Panchayat Samiti. Learned counsel submits that they may be allowed to enter the Kharibari jurisdiction to attend the meetings of panchayat samiti.
2. Learned counsel for the State has strongly opposed the application. Learned counsel submits that the petitioners have violated the order of this Court and had even entered the jurisdiction of Kharibari Police Station except for the purposes as mentioned in the anticipatory bail order.
3. The petitioner nos. 1 and 2 are admittedly the member of the Kharibari panchayat samiti. The certificate being issued by the Panchayat Returning Officer is
3 taken on record. Petitioner nos. 1 and 2 being the member of the panchayat samiti are duty bound to attend the meetings in order to discharge their duty and perform the function as elected representatives.

In the circumstances the Court relaxes the condition as imposed in order dated 22nd May, 2025 only to the extent that the petitioner Nantu Mandal @ Nantu Mandol and Manisha Sarkar may enter the jurisdiction of Kharibari Police station for the purpose of attending Kharibari panchayat samiti meetings and meet the Investigating Officer as and when summoned. The office of the Kharibari Panchayat samiti shall issue a certificate of attending the meeting. As far as the contention of the learned counsel for the State is concerned, if the petitioner violate any condition of the anticipatory bail order, the anticipatory bail shall automatically stand cancelled as mentioned in paragraph 11 of the order dated 22nd May, 2025
5. With the observations, CRAN 1 of 2025 stands
disposed of.
6. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
