By way of this petition, the petitioner has challenged the order passed in a departmental enquiry whereby he has been degraded from his post. The petitioner filed an appeal against the said order on 03.10.2022, which is stated to be pending consideration before the appellate authority. 2. Learned counsel for the petitioner submits that despite the appeal having been filed more than two years ago, it is yet to be decided by the appellate authority. The petitioner prays that the appellate 3 authority be directed to dispose of the appeal expeditiously, preferably within a stipulated timeframe. 3. Having heard learned counsel for the petitioner and perused the record, it is apparent that the delay in disposal of the appeal is causing undue hardship to the petitioner. The appellate authority is expected to function without undue delay and to render justice in a time-bound manner. In view of the submissions and the circumstances of the case, this Court directs the appellate authority to consider and decide the appeal filed by the petitioner dated 03.10.2022 preferably within a period of 45 days from the date of receipt of this order. 4. It is made clear that the Court has not expressed any opinion on the merits of the case, which shall be decided by the appellate authority on its own merits and in accordance with law. 5.
