She has made a representation before the competent authority but to no avail. The only prayer made by Shri Virendra Kumar Shukla, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Neeraj Dube, learned counsel for the respondent No.2 submits that the matter requires determination of facts by the competent authority in light of the applicable provisions of law in the first instance. However, he fairly contends that her pension benefit is liable to be decided by the competent authority in a reasonable time frame. In wake of the submissions made at the Bar and without going into the merits of the case, the respondent No.2- Executive Officer, Cantonment Board, Varanasi is directed to decide the representation of the petitioner regarding recomputation of her pension as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
