This petition has been filed by the petitioner seeking a direction to the respondents to remove the illegal encroachment of respondent No. 5. 2. An impleadment application has been filed by one Deepak Gaur, inter alia, placing on record the documents to indicate that FIR has been lodged against the petitioner seeking to take possession of the property in question and that the property in question has been purchased by the said applicant, wherein the petitioner was making attempts to take possession. 3. Filing of the Public Interest Litigation, pertaining to the subject matter qua which the petitioner is being investigated on an FIR lodged against him, is gross misuse of process of filing of Public Interest Litigation. 4. Counsel for the petitioner regrets filing of the petition without seeking complete instructions from the petitioner pertaining to the subject matter and/or whether he had any interest/connection with the subject matter. 5. In view of the above, while warning the petitioner and advising the counsel for the petitioner to take care in future, the petition is dismissed for remaining cautious in future.
