MAHESWARI ARIKA 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the Respondent Nos.3 to 5 in interfering in civil dispute at the behest and influence of 6th and 7th Respondents with regard to the residential land i.e. Plot No.115 Paiki Part Within the above boundaries East to West Northern side 60 feet or 18.30 mts, East to West Southern side 60 feet or 18.30 mts, North to South on Eastern side 23 feet or 7.01 mts and North to South on West Southern side 23 feet or 7.01 mts, vacant site full, situated in Sircar Sy Nos. 425/1 to 3 of Ponnutipalem Revenue Village, 1st Ward Nakkaladinne lanes and Byelane, Madanapalle Revenue Mandal Principality, Chittoor District as illegal, arbitrary, unconstitutional and violative of article 14, 21, 300-A of The Constitution of India.” 2. When the matter is taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home would submit that in view of the interim order dated 14.02.2022 in I.A.No.1 of 2022 passed by a Coordinate Bench of this Court, the Police are not interfering in the civil disputes between the parties. 3. Sri Rachuiri Lakshmikar, learned counsel for the Petitioner would submit that, recording the same, the petition may be disposed of. 4. For ready reference, the interim order dated 14.02.2022 passed in I.A.No.1 of 2022 by a Coordinate Bench of this Court, is extracted hereunder: “There shall be a direction to respondents 3 to 5 – police officials not to interfere in the civil disputes between the 3 petitioner and unofficial respondents relating to residential plot bearing No.115, which is situated in land covered by Sy.No.425/1 to 3 of Ponnutipalem Revenue Village of Madanapalle Mandal, till the next date of hearing.” 5. In the light of the above interim order, the Writ Petition is disposed of. However, Police are directed not to interfere in the civil disputes between the Petitioner and Respondent Nos.6 and 7. There shall be no order as to costs.
