1. By way of the present writ petition, learned counsel for the petitioner submits that the petitioner is the land owner of land bearing khasra no. 924 rakba 0.1600 hectare, 925 rakba 0.1000 hectare and 932 Digitally signed by JYOTI JHA Date: 2025.10.07 11:31:48 +0530
2 rakba 0.1800 hectare land situated at Village Anandgaon Tehsil Berla, District Bemetara (C.G.) the petitioner is age about 65 years and he is illiterate the petitioner need of Rs. 1,50,000/- for his house hold emergency he is taken from said amount for respondent NO. 5 and in lieu of that the petitioner is given his Rin Pustika of the said land to the respondent No. 5, the respondent No. 5 while committed fraud and cheating taken the signature of the petitioner in one paper and given assurance that his paper will be return while the amount will be return, he prepared the power of attorney upon that paper and he is shown himself as a power of attorney holder in the said land and sale out the said property to respondent No. 6, the petitioner is approach the respondent No. 5 for returning the amount along with interest and paying the Rin Pustika as well as the particular sign paper that time the respondent No. 5 communicated this fact that he had sale out the said property to respondent No. 6 and warn the petitioner to do what to do, the petitioner is subjected to fraud by the respondent No. 5 and 6 and he made written complaint to the Superintendent of Police Bemetara, District Bemetara on 11.08.2025, till date though the police is not cognizance and his complainant under the investigation, the revenue record is also shown that the said land is sale out by power of attorney holder by respondent No. 5 to respondent NO. 6 and according to that the mutation entries are done in the name of respondent No. 6. These mutation entries are shown that the petitioner is subjected to cheating. Hence this petition.

Learned counsel for the respondent opposed the submission made by the learned counsel for petitioner.

3. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case, instead of keeping the present writ petition pending, I find it appropriate to dismiss the petition of the petitioner as no ground is made out by the petitioner which warrants interference because the dispute is between petitioner and private respondents, as such the present writ petition is not maintainable. Accordingly the writ petition is dismissed.
5. However the petitioner is at liberty file civil suit before the Competent Court, if he so advised.
6. Subject the petitioner furnishing photocopy of the documents, the certificate copy shall be returned to the petitioner. Sd/-
