1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“ a. Issue a writ of mandamus directing Respondents to conduct draw of lots (if pending) and issue allotment-cum-demand letters forthwith for the 26 Petitioners for EWS flats in Narela, on parity with the 189 allottees from the same cluster. b) Direct the Respondents to convene a joint facilitation camp This is a digitally signed order. within a fixed timeframe for the Petitioners, with the participation of banks/financial institutions, to accept the beneficiary contribution and process loan applications as per the 2015 Policy. c) Direct the Respondents to grant physical possession of the allotted flats to the Petitioners within a specified period and ensure that the relocation site is equipped with all basic amenities as recorded before this Hon'ble Court. d) Nominate a nodal officer with contact details and file a compliance/status report within two weeks detailing timelines for issuance of allotment letters, receipt of deposits, and possession for these 26 Petitioners...”
2. In W.P. (C) 8035/2024 the High Court issued time bound Rehabilitation Schedule for Madrasi Camp at Jangpura. 3. Thereafter, DUSIB/respondent no. 5 issued a list of 189 eligible dwellers and they were rehabilitated. The petitioner/26 dwellers also applied for allotment on the basis of parity of the 188 allottees. 4. Since DUSIB policy provides for a mechanism for appeal, various appeal were filed and DDA was informed by DUSIB on 16.05.2025 that 26 persons were found eligible for allotment. 5.
The Appellate Authority order dated 16.05.2025 has attained finality and all the 26 allottees have received the Provisional Eligibility Letters from DUSIB the question now remains only for allotment of the flats. 6. Ms. Kakar, learned counsel states that the respondent/DDA is only allotment agency and once payment is made by DUSIB/PWD, the allotment in favour of the petitioner will be made. 7. In view of the above narration, there is no dispute on the factual matrix. The only requirement is that the payment of the flats is required to be made by DUSIB/PWD and on payment, the flats are to be allotted to the 26 petitioners on parity with the other allottees. 8. Since some amount has already been paid, the balance amount if any due and payable will be paid by the DUSIB/PWD within 8 weeks from today and the allotment shall be carried out and possession handed over within 6 weeks thereafter. 9.
