1. The petitioners claim to be displaced persons as a result of a huge chunk of land being declared as forest land under the provisions of the Indian Forest Act, 1927. The land was utilized for construction of Nanak Sagar Dam. The petitioners are claiming rehabilitation as per G.O. dated 3.7.2020 whereby a Committee was constituted for considering the claim of displaced persons. It is submitted that in similar facts and circumstances, a large number of displaced persons filed separate petitions before this Court and the same were disposed of by an order dated 16.1.2025 after hearing the parties. The petitioners of all those cases were permitted to submit their claims along with evidence before the Commissioner of the Division, who is the Chairman of the Committee constituted under G.O. dated 3.7.2020 and a direction was issued to the State Government to take decision in relation to rehabilitation. It is submitted that the petitioners though had not approached this Court on an earlier occasion, tried to submit their claim before the Commissioner, but the same has not been entertained on the pretext that there was no order in favour of the petitioners by this Court. In the aforesaid facts and circumstances, the instant petition has been filed. 2. Sri Rajiv Gupta, learned Additional Chief Standing Counsel, very fairly states that he has no objection in case the present petition is also disposed of in same terms as the earlier batch of petitions. 3. The operative part of order dated 16.1.2025 passed in Writ - C No. 9893 of 2024 and other connected petitions is as follows: -
"9. Having regard to the aforesaid stand, we dispose of the instant batch of petitions as follows: (a) The petitioners will have three weeks from today to submit their claim alongwith supporting evidence before the Commissioner of the division, who is the Chair- person of the Committee constituted under Government Order dated 3rd July, 2020. (c) The committee will make its recommendation to the State Government within next six weeks. (d) The State Government will take decision in relation to rehabilitation of displaced persons within next three months."
