2 Dr.YLR,J Crl.RNo.12184of2025 Dated 01.12.2025 The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to Crime No. 121 of 2025 of enlarge the Petitioner/Accused No.2 on bail in Police Station, Visakhapatnam Commissionerate, registered Maharanipeta against the Petitioner/Accused No.2 herein for the offences punishable under Sections 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, this Court, in CrI.P. No. 10675, vide order dated granted bail to Accused No.1, who was allegedly found transporting 20 kg of Ganja, which is below the commercial quantity.
The petitioner herein is Accused No.2. Based on the confession of Accused No.1, the role of the petitioner/A-2 has come to light as the ultimate receiver of the witnesses have been examined. They are all material 29.10.2025, Ganja. So far, seven and official witnesses. No adverse or similar criminal antecedents have been reported against the petitioner/A-2. The chances of the petitioner threatening the witnesses, tampering the evidence, or hampering the investigation may not arise. The petitioner is a permanent resident of Allapur, Buduan District, Uttar Pradelh>>He has got fixed abode. He was arrested on 09.11.2025. He

Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.2, this Court is inclined to enlarge the Petitioner/Accused No.2 on bail. In the result, the Criminal Petition is allowed with the following stringent

The Petitioner/Accused No.2 shall be enlarged on bail subject to him executing bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for the like sum each to the satisfaction of the learned II Additional Chief Judicial Magistrate, Visakhapatnam. ii. The Petitioner/Accused No.2 shall appear before the Station House Officer, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet, iii. The Petitioner/Accused No.2 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. \ \ iv. The Petitioner/Accused No.2 shall not commit or indulge in commission of any offence in future. V.
