IA NO: 1 OF 2013(WPMP 12905 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to allow the petitioners for Trade Test to be held on - 13-04-2013 in their ITI trades of Motor Mechanic and 'Electronic Mechanic respectively for the post of Junior Plant Attendent notified vide Notification No.01/ CGM(HR) / 2010, dt.5-1-2011 and Supplementary Notification No.01/ CGM(HR)/2011,dt.17-10-2011 without reference to impugned Notice No.11, pending disposal of the above writ petition and pass. IA NO: 1 OF 2014(WVMP 2163 OF 2014 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased vacate the Orders dated 4.4.2013 in MP No. 12905/2013 in WP No. 10406/2013, in the interest of justice Counsel for the Petitioner(S): 1. The Court made the following: :: ORDER :: The above writ petition is filed impugning the action of the respondents, in not considering the petitioners’ request for rectification of mistaken entries about ITI Trades in respect of selection to the post of Junior Plant Attendant in pursuance of notification No.01/CGM(HR)/2010 dated 05.01.2011 and supplementary notification No.01/CGM(HR)/2011 dated 17.10.2011 and to declare the action of the respondent in issuing notice No.11, disqualifying the petitioners, as illegal and arbritrary. The said writ petition was admitted on 04.04.2013 and interim order was passed in W.P.M.P.No.12905 of 2013, which reads as follows: “Though the online applications are wrongly mentioned the Trade Certificate possessed by the petitioners, since the petitioners possess the relevant Trade Certificate as per Notification, their cases deserve consideration and the Trade tests need to be conduced only in the relevant trade, which the petitioner possess. The petitioners shall be subjected to trade test, subject to production of the original qualification certificates, community certificates, online applications and if they fall within the ratio of 1:3, after deleting the 429 candidates + 97 candidates whose candidature is under cloud as of now. Their result shall also be published, without any reference to the pendency of the Writ Petition. It is always open to the respondents to call for a detailed verification of the certificates and qualifications of the petitioners.” 3. Today, when the matter is taken up for consideration, Smt. K.S.G. Padmavathi, learned counsel representing Sri G.V. Shivaji, learned counsel for the petitioners submitted that by afflux of time, the cause in the writ petition does not survive for adjudication and the writ petition has become infructuous. 4. Recording the above submission, the Writ Petition is dismissed as infructuous. No order as to costs.
