GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondents in not taking action on the complaint dated.15.8.2020, 24.9.2020, 21.12.2020 and on 16.02.2021 and in issuing a notice dated.15.12,2020 for the purpose of filing a final report in Crime No.218 of 2020 of West P.S. as False and Civil 2 In Nature, on the file of III Additional Junior Civil Judge Court, Tirupati, and declare the same as illegal, arbitrary, malafied, highhanded, set aside the same and consequently direct the Respondents herein to handover the Crime No.218 of 2020 to any other Police Station or any other agency other than the law and order for investigating into the crime afresh without there being any influence to the investigation carried by the Investigation officer of West P.S..” 2. Sri I.A.Vamsi Krishna, learned counsel representing Sri B.Jayachandra Reddy, learned counsel for the Petitioner seeks time. 3. Sri V.Farooq, learned Assistant Government Pleader would submit that the investigation in Crime No.218 of 2020 on the file of West Police Station, Tirupati has been completed and report has been filed stating that the matter is of civil nature. 4. As can be seen from the proceedings sheet dated 14.06.2021, the learned Judge raised a point about the maintainability of the writ petition without filing protest petition before the trial Court against the final report filed by the Investigating Officer referring the case as false or civil in nature. 5. In that view, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before appropriate forum in accordance with law. There shall be no order as to costs.
