POSANI AKASH The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 14199 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a writ of mandamus or any other appropriate writ, order or direction declaring the action of the respondents 2 to 4 in interfering with the civil disputes without any manner of right and also interfering with petitioner peaceful possession and enjoyment of petitioner site with an extent of Ac. 2.85 cents comprised in Sy.no 220/2A/1A, 1B, 2A1 of Manubolu Village and Mandal, SPSR Nellore District. without any manner of right as illegal, arbitrary and unconstitutional, arbitrary, colourable exercise of power and violative of art.21 of the constitution of India and consequently direct the respondents not to interfere with the possession and enjoyment of the above property and pass.…” 2. Heard Sri Siva Prasad Reddy Venati, learned counsel for the petitioner and Sri V. Farook, learned Assistant Government Pleader for Home for the respondents. 3. Learned Assistant Government Pleader for Home, on written instructions would submit that based on the complaint lodged by respondent No.5, a case in Cr.No.21 of 2023 for the offences punishable under Sections 341, 447, 506 of IPC was registered against the petitioner. After completion of investigation, the police have filed charge sheet before the learned Additional Judicial First Class Magistrate, Guntur and CC number is awaited. He would further submit that after registration of the aforementioned crime, the petitioner has filed a suit in O.S.No.18 of 2023 before the learned Senior Civil Judge Court. He would further submit that the police are not interfering in the civil disputes between petitioner and the unofficial respondent. 4. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 5. Recording the above said submission, the Writ Petition is disposed of. However, the police are directed to follow due process of law relating to the crime which has been registered against the petitioner. There shall be no order as to costs.
