This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the action of Respondent No.3 as illegal, arbitrary and violative of fundamental Rights guaranteed under Art. 21 of the Constitution of India, B)To direct Respondent No. 3 not to harass us and call to police station unnecessarily, C)To direct the Respondent No.3 to complete investigation fairly and file proper Charge sheet before concerned court as per the procedure established by law, in the interest of Justice and pass such other Order or Orders, which may deem fit and proper -n the circumstances of this Writ Petition.”

When the matter is taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint lodged by Respondent No.4, a case in Crime No.213 of 2019 on the file of Mylavaram Police Station for the offences under Sections 498-A and 506 read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act has been registered against the Petitioner and his family members. It is further submitted that, Police after due investigation, filed charge sheet in the said crime which is numbered as C.C.no.45 of 2021 on the file of the Court of Judicial First Class Magistrate, Mylavaram and the Police served notices under Section 41(a) Cr.P.C to the Petitioner and his family members and they were never called by the Police. 3
3. Sri Prudvi Raju Mudunuri, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions, the Writ Petition is disposed of. However, Police are directed to follow due process of law in connection with the case registered against the Petitioner. There shall be no order as to costs.
