The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 222/2023, registered at Police Station – Pathalgaon, District – Jashpur (C.G.) for the alleged commission of offence punishable under Sections 4, 6 and 10 of Cattle Preservation Act.

As per the case of the prosecution, on 20.07.2023, on the basis of information received from an informant during night patrolling, a pickup vehicle bearing registration No. JH 01 FB 8684 was found abandoned on the road. Upon inspection, it was discovered that the vehicle was loaded with four male calves, four cows, and five female calves. 2 thirteen cattle, two cows and two calves were found dead. On the basis of the aforesaid facts, an offence under Sections 4, 6, and 10 of the Cattle Preservation Act was registered at Police Station Pathalgaon (C.G.) bearing Crime No. 222/2023.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that the learned trial Court failed to appreciate that the present applicant was not present at the place of incident when the police found the alleged vehicle there. He further submits that the applicant had no knowledge about the incident, as the alleged vehicle had been given on rent to one Jabbar Shah for the transportation of vegetables. He contends that the present applicant has no involvement whatsoever in the aforesaid crime and has been falsely implicated by the co-accused on the basis of a memorandum. He also submits that the applicant has no criminal antecedents. Therefore, he prays for grant of anticipatory bail to the applicant.

On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant and submits that the applicant is the owner of the alleged vehicle in which four male calves, four cows, and five female calves were being transported. Out of the total thirteen cattle, two cows and two calves were found dead. Therefore, the applicant is not entitled to the grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the nature and gravity of the offence and material on record in the case diary, and the fact that the applicant is the owner of the alleged vehicle in which four male calves, four cows, and five female calves were being transported. Out of the total thirteen cattle, two cows
3 and two calves were found dead, looking to the nature of allegation, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant – Shakib Bhandari, involved in Crime No. 222/2023, registered at Police Station – Pathalgaon, District – Jashpur (C.G.) for the alleged commission of offence punishable under Sections 4, 6 and 10 of Cattle Preservation Act, is rejected.
