GP FOR REVENUE 2 HBKM,J W.P.No.11908 of 2020 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the proceedings of the 4th respondent bearing Ref.B/1228/2019, dated 28.06.2020, whereby and where- under the land assigned to the petitioner’s father under the D-Form patta for an extent of Ac.0.90 cents in Sy.No.30/2C1 of Nidigatla Village in Korukonda Mandal, East Godavari District is sought to be resumed for “Navaratnalu- Pedalandariki Illu” Scheme. 3. The learned counsel for the petitioner submits that the impugned proceedings of the 4th respondent dated 28.06.2020 indicates that since the petitioner refused to accept the compensation offered by the Government of Rs.31,27,500/-, this resumption proceedings are initiated for the purpose of the above said public purpose of housing welfare scheme. 4. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that the petitioner violated the conditions of D-form patta. 5. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject property strictly in accordance with law and if the petitioner is found to be otherwise in possession of the same, she shall be dealt with strictly in accordance with law, by giving due opportunity of hearing to all the parties concerned, including the petitioner and 3 HBKM,J W.P.No.11908 of 2020 upon verification of the records and the subject land, appropriate decision shall be taken on its own merits. Any dispossession from the subject land shall not be made except by following the due process of law. The impugned proceedings of the 4th respondent, dated 28.06.2020 is set aside herewith. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
