JUSTICE A.GUNESHWAR SHARMA 4.2.2025 Heard Mr.M.Ibohal, learned counsel for the petitioner and Mr.Th.Sukumar, learned PP for the State respondents. Petitioner approached this Court under Section 482 of the BNSS 2023 for grant of pre-arrest bail. It is submitted that petitioner is an ASHA worker of Nambol Leimapokpam Mayai Leikai and due to illness of her son she could not participate in the last March Pass in the 76th Republic Day Celebration 2025 at Imphal and for such reason she has been called by the personnel of Nambol Police Station for arresting her for supporting the cause of militants’ boycott. Mr.Sukumar, learned PP submits that no FIR has been registered against the petitioner in connection with the alleged offence made in the petition and hence, the present application is not maintainable. This Court is of the opinion that the petitioner is apprehending her arrest but on clarification of the learned PP that no FIR has been registered, the present application is disposed of with the direction to the respondents to issue a Notice under Section 35 (2) of the BNSS 2023 equivalent to Section 41 A of the Cr.P.C, in case the petitioner is required to be arrested in connection with the said offence. With this observation, the Bail application and connected misc case are disposed of. Furnish a copy of this order to learned counsel for the parties.
