GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus to declare the action of respondents more particularly 4th respondent in interfering with the erection of but by the petitioner in his own land extent Ac.0.66 cts situated in Sy.No.149 near Adivappa Matam, Yemmiganur town as arbitrary, illegal and violative of Articles 14 and 21 of the Constitution of India.” 2 2. Sri B.Sarvotham Reddy, learned counsel for the Petitioner would submit that, let there be a direction to the Police not to interfere with the peaceful possession and enjoyment of the land of the Petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that the Petitioner and others formed into a group and there is a civil dispute between them and the third parties. It is further submitted that Crime No.32 of 2022 was also registered and after investigation charge sheet was also filed before the Judicial First Class Magistrate, Yemmiganur. It is further submitted that the Police never interfered with the civil dispute. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere in the civil dispute pertaining to the subject land admeasuring Ac.0.66 cents situated in Sy.No.149, near Adivappa Matam, Yemmiganur Town, except under due process of law. There shall be no order as to costs.
